Terms of Service

Effective July 16, 2026

1. Agreement to terms

These Terms of Service ("Terms") are a binding agreement between you and ITCertFoundry ("ITCertFoundry," "we," "us," or "our") governing your access to and use of itcertfoundry.com and all associated content, courses, labs, assessments, and services (the "Service"). By creating an account, accessing, or using the Service, you accept these Terms in full. If you do not agree, do not use the Service.

2. Educational service, no outcome guarantee

ITCertFoundry provides independent certification training, labs, assessments, and study tools. Access to the Service does not guarantee a passing exam score, certification, employment, promotion, salary increase, or any other personal or professional outcome. You remain solely responsible for registering with the applicable official exam provider and complying with that provider's rules, eligibility requirements, and exam-security policies.

3. No affiliation with any certification vendor

ITCertFoundry is an independent training provider and is not affiliated with, endorsed by, certified by, or sponsored by Cisco Systems, Inc., CompTIA, Microsoft, Amazon Web Services, or any other certification body, vendor, or company whose exams or technologies are referenced in our content. All product names, logos, and trademarks referenced on the Service (including Cisco, CCNA, and Packet Tracer) are the property of their respective owners and are used solely for identification and nominative fair use in describing exam objectives. The Service uses original instructional content written by ITCertFoundry and does not provide, sell, or facilitate access to actual exam questions, exam dumps, or any other confidential exam material in violation of any vendor's certification agreement.

4. Accounts

You must provide accurate, current information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, to create an account. Notify us immediately of any unauthorized use of your account.

5. License, intellectual property, and acceptable use

All course content, lessons, labs, assessments, explanations, video, text, graphics, software, and other materials made available through the Service (the "Content") are owned by ITCertFoundry or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, ITCertFoundry grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Content for your own individual study. No ownership rights are transferred to you.

You may not, and may not permit or assist any third party to: copy, reproduce, republish, upload, post, transmit, sell, resell, rent, lease, sublicense, distribute, or otherwise make the Content available to anyone outside your own individual account; share your account or login credentials with any other person; scrape, mirror, cache, or systematically download Content using automated means; remove or alter any copyright, trademark, or proprietary notice; or use the Content to create a competing product or service. Accounts and paid access are strictly for the use of the individually registered user.

Unauthorized copying, reproduction, redistribution, or resale of Content is a material breach of these Terms and an infringement of ITCertFoundry's intellectual property rights. ITCertFoundry may pursue any and all remedies available at law or in equity for such conduct, including immediate account termination without refund, injunctive relief, monetary damages, statutory damages under applicable copyright law, and recovery of reasonable attorneys' fees and costs. We reserve the right to send takedown notices and pursue claims against any platform, marketplace, or individual found distributing or reselling ITCertFoundry Content without authorization.

6. Lab safety and real-world use

Training materials, commands, and lab exercises are provided for personal study in an authorized practice or simulated environment only. You are solely responsible for ensuring you have explicit authorization before applying any command, configuration, or technique demonstrated in the Service to any system, network, or device you do not own or do not otherwise have express permission to administer. ITCertFoundry is not responsible for any damage, downtime, security incident, or legal liability arising from your use of Service content outside of an authorized practice environment.

7. Payments, all sales final, and feedback

Payments are not currently being collected. When paid enrollment opens, applicable pricing, billing terms, and renewal details will be presented and must be accepted before purchase.

Once paid enrollment opens, all purchases will be final. Except where a refund, credit, or cancellation right is expressly required by applicable law that cannot be lawfully waived by agreement (for example, certain consumer-protection or distance-selling laws in your jurisdiction), ITCertFoundry does not offer refunds, credits, exchanges, or cancellations for any course, product, or subscription, including for partial use, non-use, change of mind, or failure to pass a certification exam. We do not offer refunds, but we take product feedback seriously: if a course did not meet your expectations, we welcome you to tell us why through our support channel so we can improve and tailor the material for future learners. Where a mandatory statutory refund or withdrawal right applies to you and cannot be excluded, that statutory right controls over this section, but only to the minimum extent required by law.

8. Prohibited conduct

In addition to the restrictions in Section 5, you may not use the Service to: violate any applicable law or regulation; violate the exam-security or acceptable-use rules of any certification vendor; interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or any connected network; upload malicious code; impersonate any person or entity; or harass, abuse, or harm another user. We may investigate suspected violations and cooperate with law enforcement where appropriate.

9. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMER IS PROHIBITED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS ACCURATE OR CURRENT WITH RESPECT TO ANY THIRD-PARTY CERTIFICATION EXAM.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ITCERTFOUNDRY AND ITS OWNER, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ITCERTFOUNDRY'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ITCERTFOUNDRY IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, FRAUD, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, WHERE AND TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless ITCertFoundry and its owner, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Service, your violation of any law, or your infringement of any third-party right, including unauthorized copying, redistribution, or resale of Content.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms, including fraud, abuse, credential sharing, unauthorized redistribution of Content, security threats, or nonpayment. Sections of these Terms that by their nature should survive termination — including intellectual property, payment obligations already incurred, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

13. Governing law, dispute resolution, and international users

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods, which does not apply. Subject to the arbitration agreement below, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Texas for any dispute not subject to arbitration.

Before filing a claim, you agree to first contact us and attempt to resolve the dispute informally. Except for claims that qualify for small-claims court or claims for injunctive relief regarding intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration rather than in court, except that either party may bring an individual action in small-claims court. YOU AND ITCERTFOUNDRY EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court rather than in arbitration, and the remainder of this arbitration agreement remains in effect.

If you are accessing the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local law. Nothing in these Terms overrides any consumer-protection right, withdrawal right, or other mandatory protection that applicable law in your country of residence grants you and that cannot be waived by contract; where such a mandatory right conflicts with a provision of these Terms, that provision applies only to the extent consistent with the mandatory right, and the rest of these Terms remains in full effect.

14. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service, and may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. General

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ITCertFoundry regarding the Service and supersede any prior agreements. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
